| If you are arrested for disorderly conduct or trespassing and an officer says you can just pay a fine and that will resolve the case, DON'T DO IT! These are criminal charges that will stay on your record and can come back to bite you in the future. Fight the case and avoid a conviction on your record! |
| Many DUI's begin when drivers are pulled over for expired registration or a broken taillight. Make sure to keep your registration up to date and do not give the police any reason to pull you over. Just a drink or two could put you at the legal blood alcohol limit of .08. |
| After being arrested, you do not have to speak with the police. If you even ask for an attorney, the police are obligated to stop questioning you. If the police continue to question you after you say you want an attorney, your statements to them should be suppressed from trial. |
| In Delaware, you can get an adult record expunged only if you have arrests with no convictions (traffic offenses do not count). However, if you are Pardoned by the Governor for certain offenses, then you may be able to get an Expungement after a Pardon. |
| In Delaware, if you are convicted for possession of Marijuana (or another illegal drug), then your driver's license will be suspended for TWO years. This applies for any amount of Marijuana, even for one joint. If convicted of Possession With Intent to Deliver or Trafficking, then the loss of license is THREE years...and there is mandatory jail time for Trafficking of at least TWO years. |
| In Delaware, self-defense or 'justification' is a viable defense. The use of force against another is justifiable when one believes that such force is immediately necessary for protecting oneself against the use of unlawful force by another. However, 'deadly force' can only be used to protect oneself against a threat of serious physical injury, death, kidnapping or sexual intercourse by force or threat. |
| In the U.S. (2005) there were approximately 1.2 million motor vehicle thefts, or 1 vehicle stolen for every 240 people in the U.S. To prevent your car from being stolen: 1. Lock your steering wheel (The Club) or brake pedal; 2. Use an immobiliser (computer chip in your key that prevents the ignition from starting without your key); 3. Use your car alarm system; 4. Get microdot I.D. tags; 5. Get killswitch circuits (which can be hidden under your seat); 6. Use signage as a deterrant; 7. Get VIN etching. OnStar or other tracking systems help police recover stolen vehicles and can disable the car from a remote location. |
| In Pennsylvania, the driving privilege of a person under the age of 18 will be suspended if that person accumulates six (6) or more points or is convicted of driving 26 miles per hour or more over the posted speed limit. The first suspension will be for a period of 90 days. Any additional occurrences will result in a suspension of 120 days. This suspension is in addition to the general requirements from accumulating points. |
| If convicted of a 1st DUI in Delaware you will lose your license for one year. On a second DUI conviction (within 5 years of the first) there is mandatory jail time. It is important to hire an attorney immediately after you are arrested in order to ensure that your rights are protected. |
